Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") defines the permitted and prohibited uses of the Social Evidence platform (the "Service"). This policy exists to protect our users, our infrastructure, third parties, and the integrity of the Service. By using the Service, you agree to comply with this AUP.

2. Intended Use

The Service is designed for the lawful preservation of publicly available social media content for legitimate purposes, including but not limited to:

  • Evidence preservation for legal proceedings (family law, civil litigation, criminal matters)
  • Forensic investigation by licensed investigators
  • Corporate compliance and workplace investigations
  • Insurance claim investigations
  • Regulatory compliance and e-discovery

3. Prohibited Uses

You must not use the Service for any of the following purposes:

3.1 Unlawful Activity

  • Any activity that violates any applicable federal, state, or local law or regulation
  • Stalking, harassment, intimidation, or threatening behaviour directed at any individual
  • Unlawful surveillance or monitoring of any individual
  • Any activity that violates a court order, restraining order, intervention order, or apprehended violence order

3.2 Harmful Conduct

  • Using archived content to harass, bully, defame, or intimidate any person
  • Using the Service to facilitate doxxing, swatting, or any form of online abuse
  • Archiving content for the purpose of blackmail, extortion, or coercion
  • Distributing archived content in a manner intended to cause harm, humiliation, or distress

3.3 Platform Abuse

  • Attempting to circumvent rate limits, access controls, or security measures
  • Using automated tools, bots, or scripts to interact with the Service beyond its intended interface
  • Attempting to access another user's account, data, or archived evidence without authorisation
  • Reverse engineering, decompiling, or otherwise attempting to derive the source code of the Service
  • Reselling, sublicensing, or redistributing access to the Service without written authorisation

3.4 Content Restrictions

  • Knowingly archiving content that constitutes child sexual abuse material (CSAM). Any such content identified will be reported to the Australian Federal Police and the National Center for Missing & Exploited Children (NCMEC).
  • Archiving content solely for the purpose of republishing, redistributing, or monetising it without the consent of the original creator

4. User Responsibility

You are solely responsible for ensuring that your use of the Service complies with this AUP and all applicable laws. Social Evidence does not pre-screen, monitor, or review the content you choose to archive. We do not make any determination as to the legality, appropriateness, or admissibility of content archived through the Service.

You acknowledge and agree that Social Evidence bears no responsibility or liability for the manner in which you use, distribute, or present archived content.

5. Share Link Responsibility

When you generate a share link, you are solely responsible for determining who receives that link and for what purpose. Share links provide temporary read-only access to archived evidence. You must not distribute share links to individuals who may use the content for unlawful purposes, harassment, or any purpose prohibited under this AUP.

6. Reporting Violations

If you become aware of any use of the Service that violates this AUP, please report it to support@socialevidence.au. We will investigate reported violations and take appropriate action.

7. Enforcement

We reserve the right to investigate any suspected violation of this AUP. If we determine, at our sole discretion, that a violation has occurred, we may take any or all of the following actions without prior notice:

  • Issue a warning
  • Suspend or terminate your account
  • Delete archived content associated with the violation
  • Report the activity to law enforcement authorities
  • Pursue legal remedies

No refund will be provided for accounts terminated due to a violation of this AUP.

8. Cooperation with Law Enforcement

We will cooperate with law enforcement authorities where required by law or where we reasonably believe that cooperation is necessary to prevent harm, investigate criminal activity, or comply with legal obligations. This cooperation may include disclosing account information, archived content, and usage data in response to valid legal process.

9. No Endorsement

The availability of the Service for a particular use case does not constitute an endorsement, recommendation, or approval of that use by Social Evidence. You are solely responsible for determining whether your intended use is lawful, ethical, and appropriate.

10. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated policy.
