1. Acceptance of Terms

By accessing or using the Social Evidence platform at socialevidence.au (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after modifications constitutes acceptance of the updated Terms.

2. Description of Service

Social Evidence provides a forensic evidence archival platform that enables users to archive publicly available social media content from supported platforms (currently TikTok and Instagram). The Service includes automated media download, AI-powered transcription, forensic screenshot capture, metadata extraction, AI-powered evidence search, and temporary evidence sharing.

The Service is a technology platform. It is not a law firm, does not provide legal advice, and does not guarantee the admissibility of any evidence in any legal proceeding.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Account Registration

You must register for an account using Google OAuth to access the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate any account at our sole discretion, without notice, for any reason including but not limited to violation of these Terms.

5. Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You represent and warrant that:

  • You have a lawful basis for archiving the social media content you submit for processing
  • Your use of the Service does not violate any applicable law, regulation, court order, or the rights of any third party
  • You will not use the Service for any purpose that constitutes stalking, harassment, intimidation, or any unlawful surveillance
  • You are solely responsible for determining the legality of archiving specific content in your jurisdiction

6. User Responsibilities

You are solely responsible for:

  • Ensuring your use of the Service complies with all applicable laws, regulations, and professional obligations
  • The accuracy of any information you provide to the Service
  • Determining the admissibility, relevance, and appropriateness of any archived evidence for your intended purpose
  • Obtaining independent legal advice regarding the use of archived evidence in legal proceedings
  • The content and distribution of any share links you generate
  • Maintaining the confidentiality of your account credentials

7. Payment and Billing

Access to certain features of the Service requires payment. Pricing is displayed at the time of purchase and is subject to change. All payments are in Australian Dollars (AUD) and are processed by Stripe, Inc.

One-time payments provide 30 days of access to the archived account. Subscription payments renew automatically until cancelled. Refunds are provided at our sole discretion.

We reserve the right to modify pricing at any time. Price changes will not affect active paid access periods.

8. Intellectual Property

The Service, including its design, code, features, branding, and documentation, is the property of Social Evidence and is protected by applicable intellectual property laws.

You retain ownership of any data you input into the Service. By using the Service, you grant us a limited, non-exclusive licence to process, store, and display your data solely for the purpose of providing the Service to you.

Archived social media content remains the intellectual property of its original creators. You acknowledge that the Service archives publicly available content and that you are responsible for ensuring your use of such content complies with applicable copyright and intellectual property laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by law, Social Evidence disclaims all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components
  • Any warranty regarding the accuracy, completeness, reliability, or timeliness of any content archived through the Service
  • Any warranty that archived evidence will be admissible in any court, tribunal, or legal proceeding
  • Any warranty regarding the continued availability of social media content on third-party platforms

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOCIAL EVIDENCE PTY LTD, ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

In no event shall our total aggregate liability to you for all claims arising out of or relating to the Service exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

This limitation applies whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other basis, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Social Evidence, its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of any rights of a third party
  • Any content you archive, share, or distribute through the Service
  • Any dispute between you and any third party relating to archived content

12. No Legal Advice

Social Evidence is a technology platform. Nothing in the Service, on our website, or in any communication from us constitutes legal advice. We make no representations regarding the legal admissibility, sufficiency, or effectiveness of any archived evidence. You should consult a qualified legal professional for advice regarding the use of digital evidence in legal proceedings.

13. Third-Party Platforms

The Service archives publicly available content from third-party social media platforms. We are not affiliated with, endorsed by, or sponsored by TikTok, Instagram, Meta, or any other social media platform. We are not responsible for changes to third-party platforms that may affect the availability or functionality of the Service.

14. Service Availability

We do not guarantee that the Service will be available at all times. We may suspend or discontinue the Service, or any part thereof, at any time without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 9, 10, 11, and 16.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising out of or relating to these Terms or the Service.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Data Retention Policy, and Acceptable Use Policy, constitute the entire agreement between you and Social Evidence with respect to the Service and supersede all prior agreements and understandings.
